Township Legal Rules

 

The Township Board may vote to assess each land owner at any time by a majority vote of the board without pre notice.

If the Township Board votes an such assessment,  they must  call a Meeting of Necessity with full legal and proper notice. to all interested parties.

If after the notice and meeting,  20% of the parcel owners vote to veto the assessment, it is immediately overturned and cannot be brought up again for one calendar year. 

 

However, if the Township sends out prior to (with sufficient notice) or gives out at a meeting petitions to all parties of interest and receive 51% signed yes, they Then must a call a Meeting of Necessity at which any one land owner that does not respond is considered an automatic no. It is also stipulated that monitors  shall be present from each side of the voting blocks to assure validity. Parties not present may be represented by legally appointed proxies

The law reads that any assessment must be applied in proportion to the "benefit received. This means that any permanent parcel that has multiple lots within its boundaries will be assessed the unit parcel assessment for each lot within the parcel. The City of Freemont' connection  charge  will be allocated in the same manner. 

However, the monthly charge from the City will be applied only to the number of sewage producing dwelling within the parcel.

If the Supervisor calls a MEETING of NECESSITY 

you should be sure to attend or give proxy to someone who will be.
